Service Description
Albania Holidays is the owner and operator of the www.albania-holidays.com, www.albania-hotel.com and www.tirana-hotel.com, www.balkan-hotel.com online reservation systems. Albania Holidays is a registered Albanian travel company, which offers a vast range of tourism and related services. Through our above named websites we act as an intermediate between hotels and users in order to provide our visitors with the possibility to search and book hotel accommodation online. Our service is based on information provided by hotels. We do our utmost best to ensure that all information provided on this website is accurate. From now on the term “Albania Holidays”, “Websites” and “we” will be used to collectively identify Albania Holidays sh.p.k (Ltd), www.albania-holidays.com, www.albania-hotel.com and www.tirana-hotel.com, www.balkan-hotel.com while the phrases “Guest” or “Client” will collectively refer to entities making use of these websites to complete a hotel or other service reservation.

Hotel Information, Rating & Client Complaints
The Hotel is responsible for ensuring that the Hotel Information (i.e. description, photos etc) included on the websites), www.albania-holidays.com, www.albania-hotel.com and www.tirana-hotel.com, www.balkan-hotel.com is correct and up-to-date at all times. Finding ourselves only with a handful of officially rated hotels we have been forced to include also non rated hotels in our Websites. Rating has been decided by the owners or management of these hotels in consultation with us. We have inspected each of the hotels physically and the findings have been made known to the hoteliers to influence them in giving their properties as objective rating as possible. However Online rating should only be considered a guideline to help you, in making a more informed choice. As a double measure we have also included guest rating. Albania Holidays shall not be held responsible in respect of any claim made by any third party relating to any erroneous Hotel Information and/or descriptions and/or photos  or any other claims related to services provided by the hotel including possible discrepancies between the actual rating of a hotel and the online rating. Nor do we accept any responsibility for the guest rating section and the comments which appear there.
Complaints made by Guests regarding conditions and services provided by the hotel are to be dealt with by the Hotel directly, without mediation by Albania Holidays.

Reservation or Accommodation Agreement
By making a reservation through the Websites a direct contract is created between the Hotel and the Client (the “Accommodation Agreement”). Albania Holidays acts merely as a medium which makes possible the reservation and payment. The Client is bound to accept the Hotel as a contractual party, and to accept the online reservation in compliance with the Hotel Information contained on the Websites at the time the reservation was made.

Payment & Refusal of Service
The Client acknowledge that Albania Holidays pre-negotiates certain room rates with hotel suppliers to facilitate the booking of reservations on his behalf. The Client authorizes Albania Holidays to book reservations for the total reservation price, which includes the room rate displayed on the Website, plus processing fees of 6% of this total reservation price. The Client agrees that his/her credit card will be charged by Albania Holidays’ US based partner, Albmozaik Incorporated. The amount charged will be the equivalent of the total reservation price converted into US Dollars. In some specific cases to be determined by Albania Holidays, the Client will be required to prepay or guarantee the booking in an alternative manner. If the Client is unable or unwilling to do this, we reserve the right to refuse the reservation service.

Cancellation Policy, Claims & Refunds
The Client may cancel or change the prepaid hotel reservation or other service, but this may result in cancellation or reservation change fees, set by the service provider. Furthermore, if  the Client does not show up, cancel or change his/her reservation before the cancellation terms set by the hotel or service provider, he will be subject to a charge of applicable nightly rates for hotels and  set charges for other services. In these cases the rest of the reservation will be cancelled automatically and if the penalty applicable is less than the total amount paid by the client, the rest of the sum will be refunded by Albania Holidays. The Client must make a new reservation and payment if he would still like to arrive at the hotel on any remaining or alternative dates.

For early interruption of reserved services the same cancellation policy will apply.
For exceptions to this rule we must have a written notice in the form of a letter or e-mail or SMS message from the hotel or service provider, confirming acceptance of the interruption of services from the client without penalty.


It is the Client’s responsibility to check and accept the cancellation policy of the hotel he books as published on the Websites.
Any financial claims and compensations will be strictly based on this policy.
For tours, meetings or other services provided by Albania Holidays except online hotel reservations, the following cancellation policy will apply:

a. If the reservation is cancelled/amended 30 days or more, prior to the arrival date, then a full refund will be given minus the 6% credit card transaction charges or bank transfer charges if paid via bank wire transfer
b. If the reservation is cancelled/amended 30 to 21 days, prior to the arrival date,  a 30 % penalty and credit card or banking charges will apply
c. If the reservation is cancelled/amended 21 to 7 days, prior to the arrival date, a 50 % penalty and credit card or banking charges will apply
d. If the reservation is cancelled/amended less then 7 days prior to the arrival date a non refund will apply.
e. In case of no shows or early check outs non refund will apply

Refund Policy
The following refund policy will apply to cancellation of services:

If the Client proves that the cancellation or early check out was made in time and according to the hotels cancellation policy we will refund the whole amount paid or the difference remaining of any unused services, minus the applicable transaction fee.

Full credit card refunds without any penalty will apply to any cancellations made according to Albania Holidays’ and their supplier cancellation policies, if this cancellation is made within 30 days from the date of payment. If this 30 day limit from date of payment has passed, credit card refunds will incur a 6% penalty on the sum to be refunded  due to processing fees. 

For all other forms of payment, applicable bank or transaction fees will be charged.

Cancellations made at least 24 hours in advance for services provided directly by Albania Holidays (i.e transfers, FIT excursions, etc.) except those provided by suppliers ( i.e hotels, car rental reservations etc.) will be refunded without any penalty in compliance with points 5b and 5c above.  

Currency & Exchange Rates
Prices displayed in the Websites include all local applicable taxes and are in Euro.  However due to the fact that the credit cards are charged by a US based company, the Client’s final total reservation price will be converted into USD. Currency Exchange rates are decided by Albania Holidays based on current exchange rates with an added nominal amount to protect against currency fluctuations. Albania Holidays updates its currency exchange rate on a regular basis.  

Liability Disclaimer

The information, software, products, and services published on Albania Holidays owned websites www.albania-holidays.com, www.albania-hotel.com or www.tirana-hotel.com have been compiled in good faith. However they may contain inaccuracies or errors, including pricing errors. In particular, Albania Holidays, our linked website partners through whom we provide service do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the hotel, air, car and other travel products displayed on this website (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.), much of which information is provided by the respective suppliers.
In addition, Albania Holidays expressly reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, we will offer the Client the opportunity to keep his pending reservation at the correct price or, at his option; we will cancel his reservation without penalty.
Albania Holidays makes no representations about the suitability of the information, software, products, and services contained on this website for any purpose, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by Albania Holidays. All such information, software, products, and services are provided "as is" without warranty of any kind. Albania Holidays disclaims all warranties and conditions that this website, its servers or any email sent from Albania Holidays Websites, are free of viruses or other harmful components.
The hotels, car rental companies and other suppliers providing travel or other services on this website are independent contractors and not agents or employees of Albania Holidays. Therefore Albania Holidays is not liable for any errors, omissions, representations, warranties, breaches or negligence of any such suppliers and their employees or for any personal injuries, death, property damage, other damages or expenses resulting there from.  Albania Holidays has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force major, or other causes beyond its direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

In no event shall Albania Holidays, be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of, or in any way connected with, your access to display of or use of this website, including, but not limited to, your reliance upon opinions appearing on this web site; any computer viruses, information, software, linked sites, products, and services obtained through this website whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Albania Holidays, has been advised of the possibility of such damages.

If, despite the limitations Albania Holidays, is found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Albania Holidays will in no event exceed, in aggregate (1) the amount the Client has paid for one of our services conform the term and conditions presented herein, or (2) Two-Hundred Euro (€200.00). The limitation of liability reflects the allocation of risk between the parties and limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed its essential purpose.

Indemnification
The Client agrees to defend and indemnify Albania Holidays and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
(1) the Client’s breach of this Agreement or the documents referenced herein;
(2) the Client’s violation of any law or the rights of a third party; or
(3) the Client’s use of this Website.

Copyright Protection and Enforcement
Albania Holidays is an exclusive owner of the general and executable project, and all software applications and content of www.albania-holidays.com, www.albania-hotel.com, www.tirana-hotel.com and www.balkan-hotel.com  webpages. The author of all the information at these portals is Albania Holidays. The contents that are not in possession of Albania Holidays are identified as such in these terms and conditions and/or websites. Most photographs, are the exclusive ownership of Albania Holidays. The copyright to all materials on the above-mentioned webpages, belongs to Albania Holidays. The user and the visitor of Websites cannot copy or use the information for profitable purposes without the knowledge and written permission of Albania Holidays. All rights are reserved. The permission is given by Albania Holidays only through prior agreement in writing form. With the exception of those mentioned in this section, all other uses of material from Websites are strictly prohibited. All perpetrators will be prosecuted based on local and International copyright laws.

Changing terms of use
Albania Holidays holds the right to change the terms of use at any moment without previous notice. Changes take effect at the moment of denunciation. Visitors are obligated to notice those changes and adapt to them.
